The Client: The organisation or individual named and signed in the Acceptance section of this Agreement.
These Terms govern all services provided by Aderyn Tân Ltd. Acceptance of a quotation, written instruction to proceed, or reliance on any report constitutes acceptance. These Terms apply unless expressly varied in writing.
Fire Risk Assessments (FRA) are risk-based assessments, not certificates of compliance or guarantees of fire safety. The purpose is to identify hazards, evaluate risk to relevant persons, review existing measures, and recommend proportionate actions. Nothing transfers or discharges the Client’s duties as the Responsible Person under the Regulatory Reform (Fire Safety) Order 2005.
Services are non-intrusive visual inspections of accessible areas based on information available at the time. Housing assessments align with BS 9792:2025. Non-housing assessments may reference PAS 79-1:2020. Services are delivered within Tier 2 Fire Risk Assessor competence.
Services exclude intrusive inspection, concealed construction verification, fire engineering analysis, design, specification, approval or certification, Building Regulations compliance, compartmentation surveys or sign-off, fire door certification, external wall system appraisal (including EWS1), and system testing, commissioning, maintenance, or supervision.
Reports are based on conditions at inspection, information supplied, and reasonable professional assumptions. Assessments do not verify concealed elements. Findings are professional opinion only and do not constitute warranties, guarantees, or certifications.
The Client must provide accurate information, ensure access, maintain fire safety measures and management systems, act on recommendations within appropriate timescales, and obtain specialist advice where recommended. The Company may rely on information supplied.
The Company does not supervise, manage, verify, or certify implementation unless separately instructed in writing. Responsibility rests solely with the Client and their appointed contractors.
Where matters fall outside competence, limitations will be stated and referral to appropriate specialists recommended. This represents good professional practice and does not imply deficiency.
Reports reflect conditions at the time of inspection only. There is no ongoing duty to update unless expressly re-instructed.
Professional Indemnity Insurance is maintained at £1,000,000. The Company’s total liability, whether in contract, tort (including negligence), misrepresentation, or otherwise, is limited to £1,000,000. The Company is not liable for indirect losses, matters outside scope, inaccurate information, post-inspection changes, or failure to implement recommendations.
The Company does not warrant that all hazards will be identified, fire prevented, or compliance ensured.
Reports are prepared solely for the Client and for the stated purpose. No third party may rely upon any report without prior written consent.
These Terms are governed by and construed in accordance with the laws of England and Wales.
These Terms constitute the entire agreement between the parties in relation to the Services.
